The above file uploaded by User:Art javier was initially tagged for speedy deletion by The Big Bad Wolfowitz with the rationale "Derivative work. Uploader may have cropped this image from a record cover, but since they don't hold copyright to the original, which is presumptively under copyright, their work is self-evidently nonfree". User:Art Javier claimed on the file page that "Nikki Phoenix authorized This picture to be uploaded for general use so that it also could be used for her Wikipedia Page. I converted it to DR here. The claimed by User:Art Javier suggested that the work is likely to be a commissioned work but it was not clear weather User:Art Javier is indeed the original photographer or not. Meanwhile, the image already appears on Jetset Magazine Website and the website says "All content and materials available on jetsetmag.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Jetset Magazine, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Jetset Magazine.". I argued that the copyright notice on Jetset Magazine's website is not an evidence that they are the copyright holder of every contents on their website and in case of images, the copyright holders are the original photographers who took the images. Unfortunately, this argument was described as "Unresponsive nonsense" by User:Elcobbola who believed that "a statement on a legitimate publication's website is, in fact, exactly that." Of course, this is not correct. Jameslwoodward deleted the image that it would be restored provided "an OTRS e-mail is received from an address at nikkiphoenixxx.com that includes a free license from the photographer or a copy of the written agreement between the photographer and Ms Phoenix that allows her to freely license the image. User:Art Javier claimed to have sent the email as requested by Jameslwoodward. In other to resolve this issue as soon as possible, User:Art javier contacted jetsetmag.com that since he's the original photographer, the image should be credited to him and Jetset Magazine did exactly that. Jet Magazine credited the image to him as requested. At this point, I think the image should be restored since the website has now credited the image to the uploader. With kind regards. Just so there's no Doubt the photographer and Wikipedia user is one and the same and is who he says he is, I am who I say I am, my Lawyer is who he says he is, and my website is not a "Third Party". I have taken the liberty to post this nonsense from editors on Wikipedia who chose to talk negatively about the photographer, me, my lawyer and my site because of our choice of email services, or their lack of intelligence regarding who the photographer was, and now that he is credited as such on the Site they listed in question:

that Jetset magazine owns this photo instead of Art Javier, who is the same user who uploaded the picture years ago to donate it for public use, nor this editor who says people are "Suspect" and not who they are because of their choice of email services:

which is the stupidest and easily disproved claim from all of them since the Billboard that used this picture is clearly posted on my site next to the picture Art Javier took and owns and uploaded for public use:
And now there can be no doubt Especially since this string is on my SITE now too! :)
But, just to recap, the photographer sent in the Model Release and ID shots from the shoot, I sent in multiple emails confirming he owned the picture and so did my Lawyer and site, yet we still get editors claiming that proves nothing. This blog post, definitely ends any speculation regarding anything pertaining to this photo, the ownership, or whether He, my Lawyer, or I are real or not because of our choices of email services :) Also just to be crystal clear, the model release, which I also sent copies in to Wikipedia, clearly states Art Javier is the owner of the photo and no one else is. He not only has the right, ownership, and authority, but also my blessing to send the photo in and donate it for public use.

(Yes it's REALLY me LOL and the photographer who donated the photo and is a user on Wikipedia is REALLY himself, and my LAWYER who emailed Wikipedia is really himself as well)
